JAMMU: The Central Administartive Tribunal (CAT) Srinagar Bench has quashed the suspension of a Junior Engineer in Kashmir Valley.

Munshi Masood, working as a Junior Engineer in Kashmir Power Distribution Corporation was put under suspension vide order No. CE/D/KPDC/04 of 2022 dated 15 April, 2022. His suspension continued beyond three months and despite that, neither the suspension was reviewed nor any charge sheet was filed against him till date.

The CAT said that the Supreme Court in the case of Ajay Kumar Choudhary has clearly laid down that an order of suspension cannot be continued after expiry of 90 days when a memorandum of charges/charge sheet has not been served on the suspended employee.

Thus, the impugned order of suspension dated 15.4.2022 is liable to be quashed, the CAT said.

“The applicant will be entitled to all the consequential dues as per rules. However, the respondents are at liberty to issue a charge sheet and take further disciplinary action as they deem fit,” the CAT ordered.
