JAMMU: Jammu and Kashmir government has ordered de-novo inquiry to inquire into the charges framed against Jagdcv Singh, the then SILO P/S Domana.
Qn order in this regard has been issued by the Home Department Jammu and Kashmir.
Whereas, Departmental proceedings were initiated against Shri Jagdev Singh, EXJ 905447, the then SHO Domana, in furtherance to the observations/directions of the Hon’ble High Court in judgement dated 25-042013, in Cr. Acq. Appeal No. 16/2010; and
Whereas, the Home Department served a chargesheet upon Shri Jagdev Singh vide O.M. No. Home/Gaz /Pf/53/2013/4938 dated 09.10.2014 detailing therein the charges framed against the delinquent officer. In response, a reply was filed by the delinquent Officer on 29.12.2014, which was found not satisfactory and at variance with the charges served upon him; and
Whereas, in terms of Rule 33 of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, vide Government Order No. 110-Home of 2015 dated 25.03.2015, an in-depth inquiry was ordered to inquire into the charges framed against Shri Jagdev Singh, EXJ 905447, the then SHO, Police Station, Domana. Shri Yoginder Koul, IPS, the then IGP, IR, Jammu, was appointed as Inquiry Officer; and
Whereas, the Inquiry Officer furnished his report dated 07.10.2015, in which he inter-alia concluded that the charges framed against the officer could not be proved and accordingly it was recommended that the Charged Officer may be exonerated of the charges; and
Whereas, the matter was further examined in the Home Department and on the basis of the facts of the case particularly the discrepancies pointed out by the Hon ‘ble High Court during the investigation and prosecution of the case related to FIR 58/2003, which involved the delinquent officer, the Competent authority has approved conducting a denovo inquiry into the charges framed against Shri Jagdev Singh, EXJ 905447, the then SHO, Police Station, Domana.
Now, therefore, in terms of Rule 33 of the Jammu & Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, Shri Imtiyaz Ismail Parray, IPS, DIG Training, Police Headquarters, J&K is hereby appointed as Inquiry Officer to conduct de-novo inquiry into the charges framed against Shri Jagdev Singh, EXJ 905447, the then SHO Domana ( now retired SP), and served to him vide 0M No.Home/Gaz/Pf/53/2013/4938 dated 09.10.2014. Shri Suhaib Ashraf, Chief Prosecuting Officer, Police Headquarters, J&K, shall be the Presenting Officer in the said inquiry.
The Inquiry Officer shall complete the enquiry and submit his report to the Home Department within a period of thirty days from the date of issue of this order.
